Vacant Lot Issues

During a community inspection on June 15, 2017 the following lots were identified in need of significant cleanup in order to be compliant with HOA Covenant rules [HOA] and Longwood City Code [CC]. Homeowners have long complained about lack of proper maintenance of the vacant lots as being unslightly and in violation of community rules.

[HOA] Art. VIII, Sec. 8.06 Maintenance of Building and Grounds


"All lots, whether improved or not, shall be maintained in a clean and orderly condition, free from overgrown weeds and from rubbish. In the event any lot is not so maintained, Declarant, its successors and/or assigns, shall have the right to enter upon said lot for the purpose of cutting and removing such overgrown weeds and rubbish, and the expense thereof shall be charged to and paid by the Owner of such lots."


[HOA] Art. VIII, Sec. 8.13 Noxious Activity


"No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done thereon tending to cause embarrassment, discomfort, annoyance or nuisance to the community. There shall not be maintained any plants or animals, or devices or thing of any sort whose normal activities or existence is in any way obnoxious, dangerous, unsightly, unpleasant or of a nature as may diminish or destroy the enjoyment of other property in the neighborhood by the Owners thereof."


[CC] Chap. 38, Sec. 38-121 Trash & Debris


"The accumulation of garbage, trash, rubbish and other debris is prohibited and declared to be a public nuisance. This provides harborage for rodents, vermin or wild animals and may furnish a breeding place for mosquitoes."


[CC] Chap. 38, Sec. 38-141 High Grass & Weeds


"The existence of excessive accumulation or untended growth (to a height of 10" or more) of weeds, grasses, undergrowth or other dead or living plant life within 100 feet of any improved property within the City is prohibited and declared to be a public nuisance. This provides harborage for rodents, vermin or wild animals and may furnish a breeding place for mosquitoes."

  • 06-05-2017 Owner notified by email -  commercial vehicles parked on vacant lots, vacant lots overgrown and need to be mowed, yard waste, debris & junk on vacant lots, junk/dirt mound needs to be removed.
  • 06-29-2017 First Notice letter - Letter details continuing violations, specifies action that must be taken by owner.
  • 07-19-2017 Lots mowed by owner - grass 18 - 24" tall
  • 08-01-2017 Lots mowed by HOA, $120 billed to owner, grass 16"+ tall
  • 08-08-2017 Lots 71 & 72, Vines and tree debris removed, $75 billed to owner
  • 08-10-2017 Owner confirmed he has entered into a contract/agreement with a mowing service to mow the vacant lots 3 times per month (every 10 days) during the rainy season.  Beyond the high growth season lots must continue to be mowed as needed and grass will not be allowed to grow to 10".
  • 08-11-2017 Lots mowed by owner - grass 10 - 12" tall

  • 09-01-2017 Lots mowed by owner - grass 10 - 12" tall
  • 09-10-2017 Hurricane Irma - Additional tree debris laying on several vacant lots.
  • 09-12-2017 Homeowner concern: Asked that hurricane debris on vacant lots be cleaned up by the lot owner.
  • 09-21-2017 Lots mowed by owner - grass 10 - 12" tall - mowing was delayed because of Hurricane Irma and resulting debris.  Lot owner reminded that vacant lots must be cleared of hurricane debris and should take advantage of free removal of debris piles.
  • 09-28-2017 Lots mowed by owner - grass 10 - 12" tall
  • 10-03-2017 Lot owner reminded that debris should be placed next to road for free removal.
  • 10-16-2017 Lots mowed by owner - grass 10 - 12" tall
  • 10-19-2017 Board Meeting: Homeowner complaints that Lot 3 has not been cleared of hurricane debris yet.
  • 11-02-2017 Lots mowed by owner - grass 10 - 12" tall
  • 11-16-2017 Lots mowed by owner - grass 8 - 10" tall
  • 02-03-2018 Lots mowed by owner - tall winter weeds
  • 04-07-2018 & 04-08-2018 Begin cleanup of all vacant lots to remove garbage, debris, hazards, etc. Removal of 5x30 cu-yds debris.
  • 04-14-2018 & 04-15-2018 Continue cleanup. Removal of another 5x30 cu-yds debris.
